this came up at the club last night:

player 1 activated CS ut didnt have any monsters, player 2 has one.

I told him he could not activate CS at that time, is this correct?

Both players select 1 monster from their respective sides of the field and switch control of those monsters with each other. The selected monsters cannot change their battle positions this turn.

You were correct both players must have at least one monster at the time creature swap is activated.
